This page (together with the documents referred to on it) tells you the terms and conditions on which Abyssal Squid (we) supply any of the products (Products) listed on our website http://www.abyssalsquid.co.uk (our site) to you. Please read these terms and conditions carefully before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.
Please understand that if you refuse to accept these terms and conditions, you should not order any Products from our site.
These terms and conditions may be revised at any time by us updating the website. Changes to these terms and conditions will be effective immediately when they are posted on the website. We reserve the right to close the website at any time, and to amend or correct any website content, with or without prior notice.
Our Privacy Policy can be found here. Our privacy policy supplements these terms and conditions and by using our website you will be deemed to have read and accepted our privacy policy. We consider and confirm that all and any linked content to other documents and/or areas of our website form part of our Terms and Conditions.
- Placing an order
1.1 You will be guided through the process of placing an order by a series of simple instructions on the Website. When you complete your order, by pressing the ‘Place order’ button at the end of the Checkout process, we will send you an email to acknowledge your order. Please note that this email is not a confirmation or acceptance of your order.
1.2 If during processing we discover for any unforeseen reason that we cannot complete your order we will cancel the order and email you explaining why (for instance, a stock shortage, inability to obtain payment, or the identification of a pricing, product, or product description fault).
1.3 Your order is accepted and the contract concluded when the product ordered is despatched.
1.4 By placing an order with us you agree that:
- Any information provided by you will be true, accurate, current and complete.
- You are the authorised holder of any credit or debit card you may use on the website.’
- You will notify us immediately of any changes to any information you have submitted to the website.
- We may collect, store, and use information about you in accordance with our Privacy Policy
- You will only use the material on the website for your personal use only, and not for any commercial purpose whatsoever.
- E-mails sent will be deemed as read, it is your responsibility to ensure that the email address supplied is accurate and capable of receiving our e-mails.
- You have read and accept all terms and conditions including the terms in relation to Price and Promotions, Shipping and Delivery, Contract Cancellation, Returns and Refunds and Data Protection.
- Payment
2.1 Payment can be made by the methods provided for you on AbyssalSquid.co.uk website.
2.2 We will debit the payment from your chosen method of payment at the time that you place your order.
2.3 All prices include VAT (where applicable) at the applicable current UK rate.
- Price and Promotions
3.1 The prices payable for goods that you order from us are as set out in Abyssal Squid Website. We try to ensure that all the prices shown on this website are accurate. However, occasionally products are mispriced. Where a product’s correct price is lower than the stated price we will issue a refund for the difference and despatch the order in the usual way. Where a product’s correct price is higher than the stated price we will inform you of the correct price and give you the opportunity to proceed with the order at the correct price or cancel the order.
3.2 You are required to pay for delivery. Our delivery charges are set out on our website.
3.3. Price and availability information is subject to change without notice.
3.4 Abyssal Squid is unable to offer a discounted price should the price of an item decrease after you make your purchase.
3.5 Price savings are based on us previously selling the item at a higher price unless otherwise stated. Where a price saving is based on our recommended retail price (“RRP”), the acronym RRP is used. Discounts deducted from lowest priced item. Buy 1 Get 1 Free refers to least expensive item free. Buy 2 Get 1 Free refers to buy three items and get the least expensive free. Buy 1 Get 2nd Half Price refers to least expensive half price.
- Shipping and Delivery
4.1 Goods ordered by you will be delivered to the address you give us for delivery at the time you make your order. If you are unavailable to take delivery, you agree to delivery being made to a close neighbour or safe place (porch, shed or other such place).
4.2 Delivery will be made as soon as possible after your order is accepted. All ordered will be dispatched by Royal Mail 2nd Class post or alternative provider.
4.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
4.4 Goods for delivery outside the United Kingdom may be subject to import duties, taxes, and/or customs charges. These charges are levied once the parcel arrives at its destination, and must be paid by the recipient.
4.5 To get your order to you as quickly as possible, Abyssal Squid reserves the right to advise the couriers to deliver to a neighbour’s house if you are unavailable. When a signature is obtained for delivery we will not be liable for loss or destruction.
- Out of Stock items
5.1 Usually everything displayed on our website is in stock and available for immediate sale.
In the unlikely event that any ordered goods are not readily available to us, we reserve the right to cancel your order. You will receive an email notification of any order cancellation because of ‘Out of Stock’ confirming that any pre-authorisation has been released and/or payment refunded for the goods in question, in line with our Payment Terms. To the extent that the out-of-stock item forms part of a larger order, all other goods ordered by the customer will be dispatched in the normal way.
- Contract Cancellation
6.1 Due to the quick turnaround of orders we are unable to amend an order once it has been placed. Customers must ensure they check their order carefully before submitting it.
6.2 Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right and notify us no longer than fourteen working days after the day on which you receive the Products.
6.3 If you wish to exercise your right to cancel this contract we will refund the original purchase price and delivery charge, provided that you have notified us in writing no longer than 14 working days after the day on which you receive the Products, that you have taken reasonable care of the Products and they remain unused and unopened. Return shipping costs are the customer’s responsibility.
This does not affect your statutory rights.
- Returns
7.1 Abyssal Squid is happy to exchange or refund goods purchased by consumers if returned within 28 days of purchase, provided the goods are unused, unopened, in their original condition and packaging with all materials, and accessories intact. All returns must be accompanied by a valid Abyssal Squid receipt or, for online returns, your order reference number.
7.2 Return shipping costs are the customer’s responsibility.
7.3 To cancel your contract you must notify us by email, or in writing.
7.4 If you receive an item that you did not order, please notify us as soon as possible.
7.5 You cannot cancel your contract with us if you are not a Consumer. If you are seeking to order more than five items of a single product in one order or a series of orders, you will unless we agree otherwise in writing be assumed to be operating in the course of a business. As such, any supply will be on the terms of our Business-to-Business supply contract. Please contact Contact@Abyssalsquid.co.uk for more information.
- Refunds
8.1 We aim to process all refunds as quickly as possible. Please allow up to fourteen working days for refunds and replacements to be processed. All refunds will be made using the same payment method where goods were purchased in store and using the same card used to place the order online.
The customers’ statutory rights are not affected.
- Cancellation by AbyssalSquid
9.1 Abyssal Squid reserves the right to cancel the order if:
- We have insufficient stock to deliver the goods you have ordered.
- We cannot obtain payment.
- A product, price, or offer description fault has been identified.
- We do not deliver to your area.
9.2 If we do cancel your contract we will notify you by e-mail and will re-credit the payment method you used to pay as soon as possible but in any event within 30 days of your order.
9.3 We reserve the right to withdraw any products from this website at any time and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
- Resale of our Products
10.1 Products are provided for personal, domestic, and private use only.
If we reasonably believe that you are buying products from us with the intention of reselling them or in circumstances where it appears that bulk buying, reselling, drop-shipping or repeated orders for the same item/s are occurring, we may:
- refuse to accept your order; or
- cancel your order; or
- accept your order subject to agreeing additional or alternative terms with you (see below); and
- treat your order as though you are buying products in the course of your business.
In such circumstances, any rights that are granted only to a ‘consumer’ under consumer protection legislation shall not apply to you.
10.2 Additional and alternative terms which shall apply to such orders shall include:
- Consumer rights to cancel the contract within 14 days shall not apply.
- Our 28 days goodwill returns policy shall not apply.
- If the products are faulty or misdescribed, you may return them to us within 7 days. Where you use our returns service, you shall be charged the postage or other cost of returning any products to us (even where those products are faulty or misdescribed). We shall also charge you a reasonable handling fee for processing your return. Returns received after 7 days will not be processed.
- You will not be permitted to order products which are subject to promotions or special offers.
- Data Protection
11.1 Your privacy is very important to us. We will never release your personal details to any company outside of Abyssal Squid for mailing or marketing purposes. We confirm that your personal information will only be used in accordance with our Privacy Policy.
- Warranties
We do not give any warranty, condition, guarantee, or representation, express or implied, relating to the information contained on this website or on any website to which it is linked. We make no representations or warranties concerning the accuracy, completeness, or suitability for any purpose of the information and related graphics contained on this website, or on any website to which it is linked.
- Safety & Regulations
Safety is our first priority at Abyssal Squid. Please ensure that you check the labelling on the packaging, which indicates the age group for which the product is suitable. Please take note of any other warnings or recommendations and keep toys intended for older children well away from younger children.
- The right to vary terms and conditions.
We reserve the right to vary these terms and conditions at any time but, in respect of any ordered goods, the terms and conditions which apply shall be those which the customer has accepted when an order has been placed. Once an order is placed customers are deemed to have read and agreed to the terms and conditions.
- Governing Law
The contract between us shall be governed by and interpreted in accordance with English law and the jurisdiction of English courts.
